Professionals with a healthy super balance and a house on the hill. For many Dicky Beach retirees, the superannuation death benefit is the will's most important job.
Dicky Beach is a small, established coastal village with 1,921 residents and a median age of 53. Professionals make up 28.4% of the workforce, the highest share in this group, and 42.8% of dwellings are owned outright. Couples without children are half of all families (50.0%), and 17.1% are one-parent families. A wills and estate lawyer Dicky Beach professionals rely on looks closely at superannuation nominations, binding death benefit nominations and the home, because for many of these households super is a bigger asset than the house. The first conversation is free.
Superannuation does not automatically follow a will. The fund pays out according to its nomination, which may be binding or non-binding, and may be out of date or name someone you have since separated from. A binding nomination that does not match the will can override what the will says. For a household with a substantial super balance, that single document can decide more of the estate than anything else, so we review it at the same appointment as the will.

Our Birtinya office is a short drive from Dicky Beach, and appointments are booked for a full review of the will and the super nominations together. Dr Darren Catton, the firm's principal, handles each wills matter personally. He holds a Doctorate of Juridical Science from QUT, carries the TEP designation for specialist trust and estate practitioners, and sits on the Queensland Law Society's Property Law committee. The firm states he has practised Queensland estate law for more than 30 years.

Nothing on this page is personal financial, superannuation or tax advice. Enduring powers of attorney and probate are covered here as general Queensland law only.

Dicky Beach has 1,921 residents, a median age of 53, and a median household income of $1,322 a week. Housing is 65.3% separate houses and 23.0% townhouses, with 42.8% owned outright, 22.4% mortgaged and 29.4% rented. Professionals (28.4%), community and personal service workers (14.6%) and technicians and trades (14.1%) lead the workforce, with hospitals, cafes and restaurants and social assistance the largest local employers. Median rent is $400 a week and median mortgage repayment $1,863 a month.
A professional retiree household often has super as its largest asset, and a childless couple's estate is decided entirely by the will and the nominations. Our Dicky Beach appointments start with the super and the death benefit, then the home, then the executor.

Not automatically. The fund pays under its nomination, which may be binding or non-binding and may be out of date. We check it against the will so the two match.
It is a direction to the fund that it must pay the benefit to the people you name, in the way you specify. It can override what your will says about super, so it must be kept current and consistent with the will.
Under the Succession Act 1981 (Qld), a surviving spouse generally takes the estate where there are no children. Without a spouse or children it passes to parents, then siblings, then nieces and nephews. A will lets you choose instead.
Many people do, and it can be done in a specific gift or a share of the residue. We can help you word it so it is clear and avoids disputes.
It depends on the estate. The first consultation is free, and the full fee is quoted before work starts. We recommend discussing super nominations at the same appointment.
Dicky Beach is a small coastal village on the Sunshine Coast's northern beachfront, at the edge of Mooloolaba, in the Sunshine Coast Council area. It has a long-established, quieter character, with many long-term residents and a higher share of owner-occupiers than the coast's busier suburbs. Today it is home to 1,921 people with a median age of 53.
